Medical Malpractice Wrongful Death Verdict - Failure to Diagnose Bowel Obstruction
A Hamilton County (Cincinnati, Ohio) jury returned a verdict in favor of a Cincinnati family who brought suit on behalf of their deceased mother. The jury found two physicians failed to diagnose and treat a bowel obtruction. Mr. Lyon served as local counsel for the national firm Motley Rice during the discovery and trial of the case.
Bausch and Lomb Settlement: ReNu
Bausch & Lomb paid approximately $250 million to resolve 600 cases. The suits arose from allegations that patients were exposed to the fungal infection Fusarium keratitis while using B&L's contact solution ReNu with MoistureLoc. The Lyon Firm represented one individual who suffered this infection resulting in permament vision loss and corenal transplant. The case was resolved favorably for a cofidential amount.
In Re Vioxx: Settlement
Merck settled the outstanding Vioxx claims for $4.85 billion. The Lyon Firm participated in this settlement.
In Re Medtronic: Sprint Fidelis
Medtronic entered a $268 million settlement arising from the 2007 global recall of the "Sprint Fidelis" leads that were prone to fracturing. The Lyon Firm represented numerous claimants in this settlement.
In Re Trasylol Settlement
Bayer resolved certain claims for $60 Million for patients who suffered failure and death as a result of the drug Trasylol.
In Re Seroquel Settlement
AstraZeneca resolved a claim for $198 Million regarding claims that the company failed to warn about risks of diabetes and execssive weight gain. The Lyon Firm participated in this settlement and represented numerous claimants.
Auto Accident Negligence-Undersinsured Motorist
1 million dollar settlement on behalf of family who suffered the loss of their grandmother when a driver ran a stop sign. Her grandson also suffered severe brain injuries during the collision. The settlement was the policy limit of the drivers policy and applicable underinsured motorist coverage.
Medical Malpractice: Failure to Diagnose Pseudo Tumor Cerebri
Confidential settlement on behalf of minor female who suffered blindness due to a failure to diagnose and treat pseudotumor cerebri. It was alleged that the patient was exhibiting class symptoms and that the process, which affects the brain, was reversible had the diagnosis and treatment been timely.
Medical Malpractice: Medication Error During Pregnancy
Confidential settlement on behalf of a family who lost the newest member of their family due to a medication error during pregnancy. The physician failed to remove a prescription for Benicar which is contraindicated for pregnancy. The failure resulted in terminal birth defects to the child. Following discovery and mediation, the case was resolved.
Construction Site Negligence
1.2 million dollar settlement on behalf of a worker who suffered a catastrophic amputation of his leg when an excavator inadvertently rolled over him while he was performing flagging duties. It was alleged that the accident occurred due to negligent design of the construction site including a lack of signs, organization, negligent training of the driver of the machine, and negligent operation of the machine. The court ruled in favor of Plaintiff's Motion for Summary Judgment that the worker was an independent contractor and applied a general negligence standard.
Defective Hip Implant
Confidential settlement on behalf of a man who suffered a catastrophic failure of a Zirconia hip implant. The femoral head ("ball portion") of the hip shattered when the patient was simply exiting the shower. It was alleged that the ceramic part of the implant was left more fragile following a change in the heating process during manufacturing.
Auto Dealer Negligence -Defective Suspension
Confidential settlement on behalf of a man who suffered a severe spinal cord injury following an auto accident. It was alleged that the car had a defective right -rear trailing arm that caused the driver to lose control of the car resulting in the accident. The claim focused on the auto dealer's failure to recognize damage to the right rear trailing arm that was affecting the handling of the car. Following discovery and mediation, the case was resolved for a confidential amount.
Failure to Diagnose Breast Cancer
Confidential settlement on behalf of a 38 year old woman. Claim alleged a failure to Diagnose and Treat Breast Cancer, and failure to Timely Communicate Lab Results. The failure to diagnose arose from the physician’s failure to communicate the results of a positive biopsy which showed early stages of breast cancer. Had the results of the biopsy been communicated the patient would have been treated with excision and avoided chemotherapy, mastectomy, and had a 95% chance of survival.
Seat Belt Defect
Confidential settlement on behalf of a minor child who suffered a brain injury and facial deformity following an auto accident. Specifically, it was alleged that the seat belt buckle was defective in design, failure to warn, and the manufacturer was further negligent in failing to recall The case alleged that the seat belt buckle in the family Mini Van was defectively designed to inadvertently release during foreseeable accident sequences.
Underinsured Motorist Claim
1.5 million dollar settlement for an underinsured motorist claim on behalf of a family who suffered the loss of their father when a motorist crossed a double yellow line while talking on the phone.
Negligent Highway Design
Confidential settlement on behalf of a couple who suffered severe traumatic injuries following a collision with a telephone pole. The case alleged a negligent highway design, negligent utility placement, as well as negligent maintenance of the highway. The case involved the negligent maintenance and failure to safely place and remove a utility pole following numerous accidents at the site. The original placement violated State Highway Standards due to the proximity to a dangerous curve. Plaintiffs were seriously injured when the car hydroplaned into the pole.
In Re Depo Provera Settlement
Confidential settlement entered into by Pfizer to resolve all of the claims currently pending in the New Jersey State coordinated litigation. Joseph Lyon represented 13 females who suffered osteoporosis due to the failure of Pfizer to properly warn them and their physicians.
Defective Hip Settlement
Defective Medical Device: Zirconium Hip Fracture and Failure Joseph Lyon along with co-counsel Altom Maglio litigated and settled a case for a local man who suffered a catastrophic hip replacement failure due to a defective manufacturing process. The manufacturing process affected the physical integrity of the hip such that it fractured with ordinary use.
