The Lyon Firm and Joseph Lyon served as lead counsel in a product liability matter involving a recalled accelerator on a KTM motocross bike, Gray v. Graham KTM Sport Motorbikes (N.D. Miss., Case No. 3:17-cv-092). That accelerator had been recalled after reports that it could stick and cause unintended acceleration.
According to the complaint, the plaintiff purchased the bike after the recall but received no warning from the dealership. While riding with friends, he lost control during an episode of unintended acceleration. As he tried to jump clear, the bike fell onto him and his arm became trapped in the rear wheel, resulting in a catastrophic amputation. The matter resolved through a confidential settlement following limited discovery, the plaintiff's deposition, and disclosure of the life care plan.
The settlement is confidential and represents a resolution of disputed claims. It is not an admission of wrongdoing or liability by any party. Settlement results depend on the facts and circumstances of each case, and past results are not a guarantee or prediction of the result of any other case.
