Lyon Firm Files 20/20 Eye Care Class Action Complaint

On behalf of plaintiffs, The Lyon Firm has filed a class action data breach complaint against 20/20 Eye Care Network and iCare Health Solutions for a failure to properly safeguard patients’ personally identifiable information (PII). The defendants allegedly failed to protect customer data, which may have included:

  • Patient names
  • Dates of birth
  • Social security numbers
  • Protected health information

Contact The Lyon Firm if you have received a data breach notification letter from 20/20 Eye Care.

In January 2021 20/20 Eye Care was alerted to suspicious network activity, and confirmed later that personal data had been downloaded and deleted in the data breach incident. More than 3 million individuals were affected by the attack, however 20/20 Eye Care did not notify victims of the data breach until months later in a letter dated May 28, 2021.

Current and former 20/20 Eye Care patients are now at risk of identity fraud, which can potentially impact them for years to come. The Lyon Firm takes these security breaches seriously, and works to hold companies accountable when they fail to protect the privacy of customers.

The complaint against 2020 Eye Care notes a “failure to implement and maintain reasonable data security safeguards, failure to exercise reasonable care in the hiring and supervision of its employees and agents, and failure to comply with industry-standard data security practices as well as federal and state laws and regulations governing data security and privacy.”

The Lyon Firm and the courts have highlighted legal privacy duties to which companies are bound, including duties under the Health Insurance Portability and Accountability Act (HIPAA). Should any public or private entity wish to collect and store individuals’ personal data, they must keep it confidential, safe, secure, and protected from unauthorized access or disclosure.
