The Lyon Firm and plaintiffs have filed a class action lawsuit against North Broward Hospital District d/b/a Broward Health, one of the largest public health systems in the United States, for a failure to keep personal data secure.

The complaint alleges Broward Health failed to reasonably secure, monitor, and maintain the Protected Health Information (“PHI”) and Personally Identifiable Information (“PII”) of approximately 1.35 million patients. As a result, very sensitive details of their lives and identities have been accessed and exfiltrated by malicious cybercriminals intent on causing harm.

The PII and PHI accessed and leaked in the Broward Health data breach includes patients’ full names, dates of birth, addresses, phone numbers, financial and bank account information, Social Security numbers, insurance information, account numbers, medical information including history, condition, treatment and diagnoses, medical record numbers, driver’s license numbers, and email addresses.

Attorneys assert that by obtaining, collecting, using, and deriving a benefit from patient data, Broward Health assumed legal and equitable duties to individuals to protect and safeguard their Sensitive Information from unauthorized access and intrusion. Breaching these duties amounts to negligence and recklessness, and violates federal and state statutes.
