MiMedx Group, Inc., a developer of placental tissue-based products used in wound care and surgery, received an FDA warning letter in December 2023 concerning AXIOFILL, a product derived from human placental tissue. The agency questioned the product's regulatory classification and identified deficiencies in manufacturing controls. The Lyon Firm is investigating MiMedx for potential deceptive marketing and consumer protection claims.

The regulatory dispute has since taken a significant turn. In September 2026, a federal court vacated the FDA's determinations concerning AXIOFILL's minimal manipulation and classification as a biological product, sending those issues back to the agency for reconsideration.

The court ruling is an important development in understanding the current status of the dispute. Contact our class action attorneys to learn more about your potential case.

What the FDA's MiMedx Warning Letter Says

The FDA inspected MiMedx facilities in Marietta, Georgia, and Kennesaw, Georgia, between February 22 and March 2, 2023. The agency said MiMedx distributed AXIOFILL, also known as Placental Collagen Matrix, directly to healthcare professionals and medical facilities across the United States.

According to the company's product materials, AXIOFILL is intended to replace or supplement damaged or inadequate tissue. Listed clinical applications include diabetic foot ulcers, trauma wounds, deep tissue deficits and surgical wounds. The product is designed for application in dry form or as a hydrated paste.

In its 2023 letter, the FDA concluded that AXIOFILL was a drug and biological product subject to additional regulatory requirements and stated that it lacked an approved biologics license application or an effective investigational new drug application.

The agency also cited concerns involving production procedures, identity and purity testing, batch sampling, bioburden testing, component verification, endotoxin and elemental impurity specifications, and disinfectant efficacy documentation.

MiMedx disputed the FDA's regulatory position. In September 2026, the U.S. District Court for the Northern District of Georgia vacated the agency's determinations that AXIOFILL failed the minimal-manipulation standard and should be classified as a biological product rather than a medical device.

MiMedx Products and Medical Applications

MiMedx is headquartered in Marietta, Georgia, and supplies products to healthcare professionals and medical facilities rather than operating a nationwide chain of MiMedx-branded treatment clinics.

Its product portfolio includes AXIOFILL, EPIFIX, EPICORD and AMNIOFIX, among other wound-care and surgical products. The company describes its products as serving wound management, burn care and surgical applications. The FDA's December 2023 warning letter specifically addressed AXIOFILL, so its findings should not unnecessarilly be extended to every product MiMedx sells.

The Lyon Firm Investigates Potential Consumer Fraud Claims

The Lyon Firm is investigating MiMedx and potential claims involving deceptive marketing and consumer protection. The stem cell marketing investigation will examine relevant product representations and whether any statements may provide a basis for legal claims under applicable law.

The FDA warning letter and the subsequent court ruling concern regulatory classification and manufacturing requirements. Neither, by itself, establishes consumer fraud. Any potential claim would depend on the specific representations made, the circumstances of a purchase or treatment, and the applicable law.

If you received treatment involving a MiMedx product or encountered product claims you believe were misleading, contact The Lyon Firm. Learn more and share information relevant to this investigation into potential deceptive stem cell marketing and consumer fraud class actions.

No claims of wrongdoing by the company have been asserted. The Firm is still gathering information from potential claimants, and no finding of consumer fraud has been established by the regulatory proceedings described above.
